Legal system description 

The legal system of Ukraine belongs to the Civil Law. The Constitution of Ukraine has the highest legal effect. Laws and other legal documents, namely President’s Decrees and Orders, Decrees and Ordinances of the Cabinet of Ministers of Ukraine, Orders, Directives, Regulations of Ministries and Offices and so on, are passed on the basis of the Constitution of Ukraine and shall correspond them.

Tax Information Exchange Agreements 

Ukrainian DTAs include provisions for the exchange of information for tax purposes. Treaty partners may make a request for information for tax purposes to the Controller of Income Tax.

Currency and Exchange control 

The hryvnia (UAH) has been the national currency of Ukraine since September 2, 1996. 
According to art. 99 of the Constitution of Ukraine and Decree of the President of Ukraine “On Monetary Reform in Ukraine” № 762/96 dated the 25th of August 1996, the national currency of Ukraine is hryvnya. According to art. 533 of the Civil Code of Ukraine, monetary obligations shall be fulfilled in hryvnya, unless otherwise stipulated by the obligations. 
According to art. 5 of the Decree of the Cabinet of Ministers of Ukraine “On Currency Regulation and Currency Control System”, National Bank of Ukraine stipulated the dealing procedure of currency operations according to which two types of licenses shall be issued:

1. General - for commercial banks and other financial institutions of Ukraine, for the whole term of currency regulation validity; 

2. Individual - for residents and non-residents, to conduct the following currency transactions:

  • export, transfer and remittance of currency assets outside of the territory of Ukraine, except:
  • export, transfer and remittance of foreign currency outside of the territory of Ukraine, by resident individuals, in the amount established by National Bank of Ukraine;
  • export, transfer and remittance of foreign currency outside of the territory of Ukraine by resident and non-resident individuals, which was imported by them to Ukraine on a legal basis;
  • payments outside of the territory of Ukraine in foreign currency which shall be made by residents to fulfill obligations in this currency in favor of non-residents as to paying for goods, services, intellectual property rights and other property rights, except currency assets payments and those under life insurance contracts (insurance policies, licenses and certificates);
  • payments outside of the territory of Ukraine in foreign currency in the form of interests on loan, income (profit) from foreign investments;
  • export outside of the territory of Ukraine of foreign investments in foreign currency, which were effected on the territory of Ukraine before, in case of investment operations termination;
  • payments outside of the territory of Ukraine in foreign currency in the form of payment for services of air navigation maintenance of aircrafts made by European Organization for the Safety of Air Navigation (Eurocontrol) according to Multilateral Agreement on Route Charges Payment (994_377), concluded in Brussels on the 12th of February 1981,as well as other international agreements;
  • import, transfer and remittance of the currency of Ukraine into Ukraine, except the cases stipulated by clause 2 art 3 of the mentioned above Decree;
  • rendering and obtaining of loans in foreign currency by residents, if the terms and amounts of such loans exceed the limits determined by the legislation;
  • foreign currency use on the territory of Ukraine as means of payment or pledge;
  • placement of currency assets on the accounts and deposits outside of the territory of Ukraine, except:
  • opening of accounts in foreign currency by resident individuals for the period of their staying abroad;
  • opening of correspondent accounts by the authorized banks;
  • overseas investing, including by funds acquisition, except those funds or other corporate rights received by resident individuals as a present or inheritance.


The order of currency movement (import, export, remittance) through the Ukrainian customs for residents and non-residents is determined by Instructions on cash and bank metals movement through the customs of Ukraine № 148 dated 27.05.2008.
